Show Your Opposition to Senate Bill S-1971

New Jersey Senate Bill S-1971, also known as the 'Owners' Rights and Obligations in Shared Ownership Communities Act,' was heard by the Senate Community and Urban Affairs Committee on Thursday, Oct. 2, 2008. After testimony both in support of and in opposition to the bill, S-1971 was pulled for additional work and will likely be brought back to the committee at a later date. Please make every effort to help us defeat this misguided legislation.

The New Jersey Chapter of Community Associations Institute (CAI-NJ) is STRONGLY OPPOSED to this bill, sponsored by Senators Shirley K. Turner (D-15) and Ronald L. Rice (D-28), and here are some reasons why you should be too:

S-1971...
  • Creates a new bureaucracy (“Commission on Shared Ownership”) to oversee community associations in the office of the Public Advocate;

  • Imposes fines on Board Members;

  • Calls for ADR for EVERY possible dispute including delinquent assessments, problems with vendors, election disputes, etc.;

  • Grants the Public Advocate unbridled authority to impose fees for ADR, as well as to allow or not allow liens or fines;

  • Virtually eliminates immunity now permitted by statute for ordinary association negligence;

  • Guarantees free use of association meeting room by any group seeking to oppose the Board, notwithstanding uniform meeting room policy;

  • Allows NO construction by associations of any new improvement, no matter how small or inexpensive, without two-thirds of all owners approving.
